Since our last Client Update, we have continued to see considerable litigation in the tendering area. The following outlines some of the key new cases out of Newfoundland and Labrador which expand upon the developing duties and obligations of those involved in the tendering process. This Update also reviews the liability of municipal inspectors in the context of a Nova Scotia residential construction case, and a new mechanics’ lien case in New Brunswick which addresses the Court’s approach to procedural issues.
